Information for Clients Regarding Legal Regulations Concerning Personal Data in Connection with Legal Services

Due to the fact that:

  1. IURICO Law Firm – Skory and Sołtys Professional Partnership of Legal Advisors conducts regulated activities and is a subject that meets specific requirements in terms of the security of the data provided to it, as detailed, among other things, in the Act on Legal Advisors;
  2. The partners of the Law Firm, as well as legal advisors providing legal services, including legal trainees, are obliged to maintain the professional secrecy of all information, including personal data, received from the client and obtained in any other way for the purpose of providing legal assistance;
  3. In accordance with the applicable regulations, the data controller for personal data obtained in connection with the provision of legal services is the Skory and Sołtys Professional Partnership of Legal Advisors, within which the profession is practiced by the Partners (Maciej Skory and Bogusław Sołtys), as well as other legal advisors employed or cooperating with the Law Firm;

– We hereby inform you, as our Clients and independent Personal Data Controllers, about the legal regulations regarding personal data applicable in connection with the provision of legal services:

§ 1. (Disclosure of Personal Data):

  1. You are the Administrator of personal data, among others, of the following categories of individuals:
    – Your representatives, employees, and contractors of civil law agreements concluded with you;
    – Contractors and employees, as well as contractors’ contractors, including service providers and service recipients, as well as debtors and creditors.
  2. For the proper implementation of the subject matter of the legal services agreement, the Administrator, if necessary, provides the Law Firm with, among others, personal data of individuals indicated in paragraph 1 above (hereinafter referred to as “Data”).
  3. The purpose and scope of providing such Data result directly and are limited to services arising from the legal services agreement and related legal obligations defined by law. The Law Firm is authorized to carry out Data processing operations specified in legal regulations.
  4. The Data provided to the Law Firm will be processed by the Law Firm in paper and electronic form.
  5. The Law Firm uses appropriate technical and organizational measures within the meaning of the Regulation of the European Parliament and of the Council (EU) of April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation – GDPR), which ensure the security of the provided Data, adequate to the nature, scope, context, and purposes of processing and taking into account the risk of infringement of the rights and freedoms of natural persons of varying likelihood and severity of the threat.
  6. The provided Data will be processed exclusively within the territory of the European Union or the European Economic Area. The Data will be stored for the duration of the contract, until the expiration of claims, subject to periods specified by law.
  7. Providing Data is not mandatory, but failure to provide it will make it impossible or significantly difficult to perform the legal services agreement.
  8. The recipients of the Data will be entities authorized to process data under legal regulations, judicial authorities, and public administration bodies within the limits permitted by law, as well as legal advisers and other entities cooperating with the Law Firm (e.g., accounting office).
  9. Individuals whose Data is processed have the right to access personal data, rectify, delete, or limit processing, as well as the right to object and the right to data portability as provided by law. In addition, they have the right to lodge a complaint with the President of the Office for Personal Data Protection.

§ 2. Duties of the Law Firm

  1. The Law Firm is obligated to exercise due diligence in accordance with the professional nature of the services provided, particularly to ensure that the shared Data is kept confidential by individuals authorized to process it.

  2. Upon termination or expiration of the contract for legal services, the Law Firm will cease processing personal data within the time frame and scope specified by applicable regulations.
